Who runs this service

unlayered.cloud is run by unlayered, an independent company that owns the brand, provides the service and holds your contract.

Who you are contracting with

When you register an account, buy credits or order a server, your contract is with unlayered and with nobody else. unlayered is an independent company: it runs unlayered.cloud, provides the service, takes the credits, owes you everything promised here and answers any claim you bring. Questions about these terms go to the channels in the Contact section at the end of this page.

unlayered.cloud, the unlayered name, the unlayered logo and the identity they form belong to unlayered. Anything you are owed under these terms, you are owed by unlayered.

What the service is

A panel for renting servers, paid for out of a prepaid credit balance. Two kinds of product are offered:

  • Virtual servers. Provisioned automatically once the order is placed and the credits are taken. Hostname, address and expiry date are shown in the panel.
  • Dedicated servers. Racked by hand by our staff, so delivery is not instant. Access details, including out-of-band management and the initial root credentials, are handed over to you inside the panel once the machine is ready.

Support is handled through the ticket system in the panel. Two other channels, Telegram and Email, reach us just as well, and all three are listed under Contact at the end of this page. There is no phone or on-site support.

Your account and your account token

Accounts have no password. You register once and receive a single account token, which is the only thing that proves the account is yours. Only a SHA-256 hash of the token is stored, so nobody, including us, can read it back out of the database or send it to you again.

If you lose the token, you lose the account, unless you have linked and verified a recovery email address beforehand. With a verified address you can sign in through a one-time link sent to it. Linking one is strongly recommended and takes a minute in the panel.

You are responsible for keeping the token safe and for everything done under your account, including anything done by somebody you gave the token to. Tell us immediately if you think it has been exposed, and a replacement token can be issued, which invalidates the old one.

Credits and payment

The service is prepaid. You top up a credit balance and every product is paid for out of that balance. Top-ups are made in cryptocurrency through our payment provider, are invoiced in US dollars, and are added to your balance once the provider confirms the payment. We never see or store your payment details.

  • Payment is by cryptocurrency only, handled entirely by our payment provider. There is no card payment, no direct debit and no invoicing after the fact, and no payment details ever reach us or are stored by us.
  • Every price on this site, every invoice and every balance is denominated in US dollars. The provider converts to the coin you choose at the moment you pay.
  • The payment provider charges a 1.5% commission and it is added to the invoice, so the amount you send is slightly more than the credit you receive: a $25.00 top-up is invoiced as 25.375 and credits $25.00. The panel shows that split before you commit to a payment.
  • Credits are a prepayment for our services only. They are not money, not a deposit, cannot be transferred to another account, and cannot be paid out.
  • Plan prices are shown per month, per server.
  • Some plans carry a one-off setup fee. Where they do, the fee is shown next to the price and is taken together with the first month.
  • A ledger of every credit movement, covering top-ups, purchases, renewals, refunds and corrections, is visible in your billing view.

Billing cycle and renewal

Servers run in monthly periods. At the end of each period the next month is taken automatically from your credit balance, so keeping enough credits on the account is what keeps a server running. Nothing is ever charged to a card or invoiced afterwards.

  • If the balance is not sufficient when a server expires, that server is suspended. It stops serving traffic but its data is kept.
  • A suspended server is reclaimed five days after suspension. Reclamation deletes it, and the data on it, permanently. Top up and renew within those five days to keep it.
  • Keeping your own backups is your responsibility.

Delivery of the service

Everything here is a digital service, delivered to your account rather than shipped. What you buy and when it arrives is set out below, and nothing is held back pending a manual approval step.

  • Credits. Added to your balance as soon as our payment provider confirms the payment on-chain, normally within minutes. The receipt appears under Invoices with the amount, the date and the order reference.
  • Virtual servers. Created automatically the moment you order, without waiting for a human. The hostname, the IP address, the root password and the renewal date are shown in the panel as soon as the machine exists.
  • Dedicated servers. Assembled and racked by hand, so these are not instant. You are told in the panel while it is being prepared, and the access details, including out-of-band management, are handed over there once the machine is ready.

If a product cannot be delivered, it is not sold: the order is refused before anything is taken from your balance, and a plan with nothing free to hand out is marked as sold out on the price list rather than accepting your money.

Refunds and cancellation

You can cancel at any time, and you never have to ask us to stop billing: a server is only renewed while your balance covers it, so leaving the balance alone ends the arrangement by itself. What money comes back, and when, is set out here.

  • Anything we fail to deliver is refunded automatically. If a server cannot be created after you order it, the credits are returned to your balance in the same moment the attempt fails, and the failed order is recorded in your ledger. You do not have to notice it or ask.
  • A change we cannot carry out costs nothing. If an upgrade cannot be applied to a running server, the price difference is put straight back on your balance and the server stays on the plan it was already on.
  • Part-used periods are not refunded. Cancelling, suspending or deleting a server does not give back the remaining days of a month that has already been paid for.
  • Unused credits. These are not refunded automatically, and they do not expire. Ask us through a ticket, Telegram or email and we will consider returning an unspent balance case by case, in the cryptocurrency the top-up was made in, less any network fee.
  • Accounts closed for abuse. Where an account is terminated for a breach of Acceptable use, nothing left on it is refunded.

Cryptocurrency payments cannot be reversed by your bank, so there is no chargeback route and nothing to be gained by attempting one. Open a ticket instead, or write to contact@unlayered.cloud: a billing question answered is faster for both of us than a dispute nobody can unwind. Where the law of your country grants you a right of withdrawal or a refund that these terms do not, that right applies regardless of what is written here.

Acceptable use

What runs on your server is your responsibility. The following is not allowed:

  • Child sexual abuse material, in any form, and anything that sexualises a minor. We condemn it without qualification. It is not weighed against your payment or anything else, and there is no version of this service where it is tolerated.
  • Content or conduct that exists to hurt people: material depicting or facilitating human trafficking, sexual violence, torture, or violence against animals, terrorist and violent extremist material, and anything produced to organise real harm.
  • Content or activity that is unlawful where the server is located or where you are, including material that infringes somebody else's rights.
  • Attacks launched from our network, such as port scanning, brute forcing, denial-of-service traffic and exploitation of third-party systems.
  • Malware, botnet command and control, credential stuffing, carding, phishing and fraud, and the infrastructure that serves any of them.
  • Spam and bulk unsolicited messaging of any kind, and the infrastructure that supports it.
  • Anything that endangers the platform or other customers: deliberate resource exhaustion, attempts to break out of your own server, tampering with our provisioning or billing systems.
  • Reselling access to somebody you know to be doing any of the above.

Abuse of children ends the account immediately. There is no warning, no argument about severity and no refund of anything left on the balance. The server is suspended the moment we know, it and its data are deleted, the account is terminated, and the customer is banned permanently. Do not test this.

For everything else we act on credible abuse reports. Depending on severity we will contact you, suspend the affected server, or, for serious or repeated abuse, suspend the whole account and terminate it. Where abuse is urgent enough to threaten the platform or third parties, we suspend first and explain afterwards.

Availability

No uptime figure is guaranteed, and none is promised anywhere in this panel or in our plan descriptions. The service is provided as it is, with the care you would expect from a hosting operator but without a service level agreement.

Maintenance, hardware failures, network incidents and upstream problems can interrupt the service. We will avoid unnecessary interruptions and keep planned maintenance as short as we can, but interruptions are not a breach of these terms and do not by themselves entitle you to a refund or to credit.

Limits of liability

To the extent the law allows, unlayered is not liable for lost profit, lost revenue, lost or corrupted data, or any indirect or consequential loss arising from use of the service or from being unable to use it. Our total liability for any claim is limited to the amount you paid for the affected service in the twelve months before the claim arose.

Nothing in this section limits liability that cannot be limited by law, such as liability for intent, gross negligence, or injury to life and health.

Claims relating to the service are made against unlayered.

Termination

You can leave at any time: stop renewing your servers, or open a ticket asking us to close the account. No notice period applies.

We may suspend or terminate an account for breach of these terms, for abuse, for unlawful use, or where we are required to by law. On termination for breach, running servers are shut down and remaining credits are forfeited to the extent the law allows. On termination for any other reason, remaining credits stay usable until the account is closed.

Changes to these terms

These terms can change for new features, new legal requirements or corrections. The current version is always the one on this page, and the date at the top of the page tells you which version you are reading. Material changes are announced in the panel before they take effect. Continuing to use the service after a change means you accept the new terms, and if you do not, close the account.

Times and dates

Every period in these terms is counted in UTC, which is what the server itself runs on. A month is thirty days from the moment a server is created or renewed, and the five day reclamation window is counted the same way, so a renewal never lands a day early or late because of where you happen to be.

Anything a person has to answer runs on unlayered time, UTC-5. A ticket opened late in your evening may well be read the next morning on that clock.

Governing law

No country is named here. unlayered does not operate from a single central location, so these terms nominate no national law and no home court. What we go by instead is the law of common sense and manners: you say what happened, we say what happened, and whoever got it wrong fixes it.

That is a promise about how we behave, not a way of taking your rights away. Whatever law applies to you where you live still applies, mandatory consumer protections included, and nothing here asks you to give up a right you cannot give up, or to bring a claim somewhere you could never afford to bring one.

Raise anything through the channels in the Contact section first. Most of what starts as a dispute is a billing question, and answering one is faster for both of us than arguing over which court gets to hear it.

If a clause of these terms turns out to be unenforceable, the rest stays in force.
